A Lawrence Municipal Court judge on Friday sentenced a 27-year-old man to serve five days in jail and two years on probation for driving under the influence related to a March 29 crash into a Lawrence optometry clinic.

Judge Scott Miller also ordered Leith Jon Stevenson to pay $1,692 in court costs, fees and fines in connection with his DUI no-contest plea. According to city court records, a reckless driving charge was dismissed.

Stevenson was arrested after his eastbound black Chevrolet Camaro about 4:50 p.m. March 29 crashed through an exterior wall to a fitting room at the Lawrence Family Vision Clinic, 3111 W. Sixth St. Police at the time said two people inside were knocked across the room but no one was seriously physically injured, although an optician later said she suffered bruising that required a hospital visit.

Employees and customers at the clinic said after the accident they were suffering from anxiety.

According to an accident report, Stevenson’s blood-alcohol content was 0.109 after the crash. The legal limit to drive in Kansas is 0.08.

“He was polite and cooperative (after the accident), and his blood-alcohol content was not egregiously over the limit,” said defense attorney John Frydman, who added he had seen defendants who were twice or three times over the limit.

Stevenson is expected to report to the Douglas County Jail later this month for five days, and the judge won’t allow him to qualify for work release during the time. His probation conditions include completing treatment from an alcohol evaluation, abstain from drinking alcohol and having an ignition-interlock device installed on any vehicle he owns.

A future restitution hearing is still scheduled in the case about the cost of the damage. Frydman said the parties are still trying to work that out but that both Stevenson and the building’s owner had insurance.
