No charges expected in July motorcycle accident at 23rd and Iowa streets

Criminal charges will not be filed against a semitrailer driver who made an illegal left turn in front of a motorcyclist who hit the semitrailer and died, District Attorney Charles Branson announced Friday.

The accident happened July 15 at 23rd and Iowa streets.

“Kansas statutes and case law provides that a violation of a traffic statute or ordinance through inattention, unless compounded by other operational misconduct, alcohol or drug impairment or other aggravating conditions or circumstances, will not support a conviction of vehicular homicide, a misdemeanor charge,” Branson said.

According to a Lawrence police report, the driver of the semitrailer, Daniel L. Arnold, 52, of Texas, made an improper left turn, failed to yield the right of way, and disregarded traffic signs, signals or markings. The motorcyclist, Douglas Puckett, 43, of Portage, Ind., was killed when he struck the semitrailer in the intersection.

Lawrence police investigators presented the case to the district attorney’s office for review on Thursday, Branson said. It will be up to Lawrence police to issue any appropriate traffic citations in the case.
