Lawrence man acquitted in sodomy case
A Douglas County jury Thursday morning acquitted a 45-year-old Lawrence man of an attempted aggravated sodomy charge.
During a trial that began Tuesday, prosecutors had accused the man of trying to sodomize the 8-year-old daughter of his former girlfriend in February at their Lawrence home.
The jury convicted the man of one count of battery against the girl, one count of domestic battery against his former girlfriend and one count of criminal restraint. Those counts are all misdemeanors, and the convictions carry a much lighter sentence than a sex crime conviction would have, defense attorney Michael Clarke said.
District Judge Paula Martin has scheduled sentencing for Dec. 4. She has ordered that an investigation into the man’s criminal history include an alcohol and drug evaluation.
The Journal-World generally does not name anyone accused of a sex crime unless the person is convicted of one.
