Standoff suspect charged with battery

A misdemeanor charge of domestic battery was filed Monday against a Lawrence man who allegedly kept police in a standoff for more than eight hours Sunday.

But Joshua D. Smith, 26, could face more charges when Lawrence police send additional information to prosecutors, Douglas County District Attorney Charles Branson said.

Smith is being held in Douglas County Jail where he was taken by police after he surrendered outside his residence in the 3000 block of Bainbridge Circle. Assistant District Attorney Brenda Clary described Smith as an “extreme danger” to the community as well as to the 24-year-old victim of the battery and three young children who were kept in the residence for several hours before they were released.

Clary also said that Smith possessed a 9 mm handgun and an AK-47 assault rifle. Smith, who appeared over closed-circuit TV from the jail, told District Judge Peggy Kittel he never had weapons in his possession during the incident.

Kittel set Smith’s bond at $10,000. If he posts the bond, Smith is not to have contact with the victims. He is due back in court Monday for the setting of a preliminary hearing.

Police and prosecutors have not identified Smith’s relationship with the woman, but court records show he was convicted in a battery case against her in 2006. He was placed on probation then.
