Boat concern

To the editor:

Kansas law KSA 2005 Supp. 32-1128 was amended in 2006. The amendment has made my 2003 model year boat illegal to operate in Kansas.

This law has made my totally stock, factory boat illegal to operate in Kansas waters. I do most of my boating at Perry Lake. I, along with quite a few other people, are now afraid to operate our boats for fear of receiving a ticket. Several boaters are now NOT going to Perry Lake because they have recently started enforcing the new, amended laws. We are very concerned that we will no longer be able to use Perry Lake or any other Kansas waterway. I don’t think this was the intent of the law; however, it is the outcome of it. Tourism in Kansas will suffer because of this amendment.

How can the state legislate my existing boat illegal? How can marine dealers still sell boats that are illegal to operate in Kansas? If they have the popular captain’s call or are manufactured without mufflers, they are now illegal to use in Kansas. The law is very clear on this point.
