Hazardous waste brings federal charges
The owner of a Lawrence and Topeka business was indicted Wednesday for unlawfully storing hazardous waste.
David Moeller, 50, of Oskaloosa, also was indicted on one count of unlawfully transporting hazardous waste and one count of unlawfully treating hazardous waste in violation of the Resource Conservation and Recovery Act, according to the Kansas U.S. Attorney’s Office.
Moeller owns Midwest Surplus Inc., 1235 N. Third St., also located at 7515 SW Topeka Blvd., in Topeka.
State and federal inspectors have found that Midwest Surplus was storing containers of waste paint and stain without a permit.
If convicted, Moeller faces a maximum penalty of five years in federal prison and a fine of up to $250,000 on each count.
