Lawrence man gets prison term for burglary, theft
A judge sentenced a Lawrence man on Friday to serve two years and eight months in prison for a home burglary and theft last fall near Eudora.
Douglas County District Court Judge Michael Malone ordered Richard E. Elston Jr., 30, to serve 32 months for the burglary conviction and concurrently serve 12 months for misdemeanor theft.
After the guilty verdicts in the January jury trial, prosecutors had asked Malone to run the two sentences consecutively.
“Although we are disappointed that the court did not order the longer sentence, we are looking forward to pursuing our other cases against the defendant,” said Douglas County District Attorney Charles Branson.
Elston still faces two more aggravated burglary trials in the county later this year. Malone has set a May 7 trial date for charges that Elston broke into a Lawrence apartment on Nov. 24 and that he used a stolen bank card to buy merchandise at Wal-Mart.
Elston’s other trial will begin June 4 on charges he committed another burglary Nov. 23. After the January guilty verdict in the first trial, Malone revoked Elston’s bond.
