Second lawsuit filed over fatal Cat Tracker accident

? A man who suffered serious brain injuries when his head struck an overpass while he was on the roof of a Kansas State University football fan bus has filed a lawsuit against the vehicle’s owners.

Chris Orr, of Salina, filed the lawsuit this week in Douglas County District Court over the Nov. 18 accident in which he was injured and John Green, of Shawnee, was killed. Orr’s lawsuit alleges the owners and the driver of the Cat Tracker were negligent because they let people ride on the vehicle’s upper deck.

Green and Orr were atop the bus when they hit their heads on the Iowa Street overpass on the way to a game against the Jayhawks. Six other passengers ducked to avoid the 15-foot-high overpass.

Green’s widow, Samantha Green, filed a wrongful-death lawsuit earlier this month on behalf of herself and her daughter, who was not born when the accident happened.

Both lawsuits claim that the driver authorized passengers to ride atop the bus and that there were no warning signs or barricades telling people not to climb the steps to the balcony while the vehicle was moving.

But one of the owners of the bus, Manhattan lawyer Robert Pottroff, said after the crash that there was a strict rule on the bus that nobody could stand on the roof deck while the bus was in motion.

Named as defendants in both suits are Pottroff, co-owner Larry McBee, of Springfield, Mo., and driver Brent Simonsson, of Wamego.
