Former Jeff. Co. worker suing for second time
A former Jefferson County employee is suing the county for the second time, alleging he was denied a job on a road crew because of perceived health problems.
In a lawsuit in U.S. District Court, Lynn R. Zwygart alleges the county violated the Americans with Disabilities Act when it failed to hire him in summer 2005.
At the time, Zwygart already had been fired from a county job in 2003 after the county found he’d used all of his vacation and sick time while recovering from a bacterial infection and open-heart surgery. A lawsuit Zwygart filed related to that firing was dismissed when a judge ruled he hadn’t proved he was disabled, as defined by the law.
When Zwygart sought another job in 2005, he alleges, the superintendent of the county’s road and bridge department told him he was concerned about his health and was denied an interview. County officials say his application wasn’t filed in time.
He is seeking $720,000 in damages. Trial is set for July 9 in Kansas City, Kan.
