Caller’s identity sought in marijuana hearing

The question of whether a Kansas Bureau of Investigation agent must identify a known caller to a tip hot line came up during a hearing Tuesday in District Court.

Defense attorney Sarah Swain asked Kansas Bureau of Investigation Special Agent Jeff Brandau about the identity of a person who called in a tip last summer that led to the seizure of more than 20 indoor marijuana plants at a home in western Douglas County. Brandau said the caller was a “concerned citizen,” but Swain said she wanted to know the person’s identity, which was known to Brandau.

Assistant Dist. Atty. Trent Krug objected to going into the matter during the preliminary hearing, calling her request a “fishing expedition.” Judge Stephen Six said the matter would be taken up during a separate hearing next month.

A resident of the home, William M. Metz, and his daughter’s boyfriend, Jonathan Alexander of Lawrence, are charged with marijuana cultivation. The judge found Tuesday that there was enough evidence for the men to stand trial.
