Kline to appeal towing suit ruling

Kansas Atty. Gen. Phill Kline on Wednesday filed notice he plans to appeal the dismissal of his consumer-protection lawsuit against a local towing company.

Last month Douglas County District Court Judge Paula Martin dismissed Kline’s suit against TransMasters towing and owner Kevin Raasch, after finding the case was pre-empted by a federal law that limits states from regulating towing prices.

Kline is arguing that Martin missed the significance of a 1995 amendment to the law that governs interstate movers.

“We strongly believe Mr. Raasch and his company charged grossly excessive fees for services provided by the company and committed 14 violations of the Kansas Consumer Protection Act,” Kline said in a statement.

“We also believe the state is within its right to enforce Kansas law against Mr. Raasch and his company.”

It can take a year or more for appeals to be decided.
