Jurors end fifth day without Wittig verdict

? Jurors in the federal fraud trial of former Westar Energy Inc. chief executive officer David Wittig and his chief lieutenant ended their fifth full day of deliberations Thursday without reaching a verdict.

The jury plans to take off today, Monday and Tuesday for the Labor Day holiday and will return to deliberations on Wednesday. The panel received the case on Aug. 25.

Wittig and Douglas Lake, the company’s former chief strategy officer, face 40 counts each of conspiracy, wire fraud, money laundering and circumventing internal controls.

This is their second trial. Their first ended in mistrial in December after jurors were unable to reach a consensus on more than half the charges after six-and-a-half days of deliberations.
