Equal protection

To the editor:

State Sen. Phil Journey’s remarks about the Matthew Limon case, as reported in the Oct. 25 Journal-World, are disturbing. In citing society’s view of homosexuality as a reason to treat illegal heterosexual acts more leniently than illegal homosexual acts, the senator is using one injustice to excuse another. This violates the fundamental constitutional notion of equal protection under the law. That’s why the Kansas Supreme Court struck down the statute.

As usual, the conservatives’ cry of “judicial activism” is nonsense. Kudos to the court for defending long-established constitutional principles against legislators who pass unfair and discriminatory laws.
