City prevails in 6Wak ruling
Plans to build a Wal-Mart and related restaurant at the corner of Sixth Street and Wakarusa Drive have been dealt a setback by a Douglas County District Court judge.
Judge Michael Malone has released a ruling upholding a decision by city building inspectors to deny a building permit for a restaurant at the corner. The restaurant was part of a larger development that includes the construction of a Wal-Mart store that has been opposed by neighbors and is the subject of a related lawsuit.
Malone, in a ruling that was made public today, said the city was justified in denying the building permit until the lawsuit involving the disputed Wal-Mart store is concluded. The ruling does not address whether city officials acted legally in denying a building permit for the Wal-Mart store. Malone has heard arguments in that case but has not yet issued a ruling.
