A.G. releases information despite gag order

Atty. Gen. Phill Kline held a news conference Thursday on his inquisition into abortion clinics, despite a court-imposed gag order in the case.

Summoning reporters to his office, Kline released his response to a brief filed with the Kansas Supreme Court last week by two abortion clinics.

Sources familiar with the case said they assumed a lower court's long-standing gag order limited Kline's response to legal arguments in the clinics' brief.

But Kline's response included transcripts of earlier proceedings and raised legal arguments that were not part of the initial brief.

Kline spokesman Whitney Watson said the brief did not violate the gag order.

"We released information contained in our brief, just like they released information contained in their brief," he said.

Lawyers for the clinics filed a motion last month, asking the Kansas Supreme Court to lift the gag order.

"There hasn't been a ruling on that motion," said Ron Keefover, a spokesman for the Kansas Supreme Court.
