Bottom line

City commissioners will consider making changes to the city’s smoking ban that could make it easier for city prosecutors to prove that bar owners and other business owners are in violation of the ordinance.

Background

Commissioners will consider changes that would require that anytime a person was seen smoking inside a business, it would be up to the business owner or manager to prove that they were not aware of the smoker. Previously the burden of proof was on the city to prove that business owner or manager knew of the smoker but took no action.

¢ approve drinking establishment license for Red Lyon Tavern, 944 Mass.

¢ bid and purchase items:

a.) approve the bid from utility maintenance contractors for the 2005 cured-in-place project for $372,503.84

b.) authorize city manager to enter into agreement with Peridian Group for engineering services in an amount of $20,745 for design of Kansas Highway 10 at O’Connell Road.

c.) authorize rejection of bids for Schedule II of the Airport Improvement Project.

d.) authorize city manager to execute an agreement with BG Consultants for land surveying and other work for the BNSF Rail Corridor between 13th and 23rd streets in the amount of $40,988.

¢ adopt resolution establishing July 9 as the public hearing date to consider the establishment of a special benefit district for the improvement of Anna Tappan Way between Haskell Avenue and Hanscom Road.

¢ approve the following site plans:

a.) for construction of Lawrence Fire Station No. 4, to be located in the 2100 block of Wakarusa Drive;

b.) for redevelopment of a building at Eighth and New Hampshire streets for Pachamama’s restaurant.

c.) for Family Video at 1818 Mass.

¢ receive requests for applications from Kansas Department of Transportation for KLINK 2008 projects, Geometric Improvement projects for 2009 and Economic Development projects for 2009.

¢ approve as a sign of community interest a sign for the Lawrence ArtMarket at the Union Pacific Depot.
