Giddens assault suspect makes court appearance for unrelated charges

? The man suspected of stabbing Kansas University basketball player J.R. Giddens last month put in a court appearance here Monday to answer to charges he had threatened his mother and an uncle with a steak knife.

Jeremiah Creswell, 24, was charged Monday with two felony counts of aggravated assault after his arrest Sunday morning.

“He’s a mess,” Creswell’s uncle, Randall Wilson, said shortly before his nephew’s first appearance in a Johnson County magistrate court that handles domestic violence cases.

After the hearing, Wilson and Creswell’s mother, Beverly Creswell, declined the Journal-World’s requests for interviews.

Records indicate police were called to Wilson’s home shortly before 6:30 a.m. after Creswell had threatened Beverly Creswell and Wilson.

Magistrate James Phelan set Creswell’s bond at $50,000 after prosecutor Kathryn Jermann noted that the younger Creswell’s criminal record in Shawnee County includes aggravated battery and possession of cocaine with intent to sell.

Creswell’s juvenile record, Jermann said, included an incident involving a firearm.

Jermann also said Creswell was known to be affiliated with a gang in Topeka.

During the 10-minute hearing, Creswell, who appeared via video from the Johnson County Adult Detention Facility, mumbled that he understood the charges and that he could not afford an attorney.

Phelan ordered Creswell not to contact his mother, his uncle or three other family members. Creswell remained in jail Monday evening.

“Fifty thousand dollar bond is not uncommon for someone with his prior contacts with the law enforcement system and when the charges are as serious as these,” said Richard Guinn, an assistant district attorney with the Johnson County District Attorney’s Office.

Guinn declined comment on Creswell’s gang affiliation.

“I cannot specifically refer to an individual’s prior criminal history,” he said, “but we would not have stated something like on the record today in court if we did not have information to that effect.”

Creswell is accused of stabbing Giddens and four other men during a fight May 19 outside the Moon Bar, 821 Iowa, in Lawrence. The incident remains under investigation by Lawrence Police.

While in custody of Lawrence Police, Creswell was taken to the Shawnee County Jail after authorities realized a municipal court warrant had been issued for his arrest. He posted bond a day later.

The Sunday incident is not expected to lead to Creswell’s bond being revoked in Shawnee County.

“There were no conditions on his bail, so there would be no grounds to revoke it,” said Ruth Maus, a spokeswoman for Topeka Municipal Court.

The warrant was issued, Maus said, after Creswell failed to appear for a court appearance in September 2004 involving charges of criminal damages to property, interfering with a police officer and disobeying a lawful order.

Creswell is scheduled to appear in Topeka Municipal Court on June 27. His next appearance in Johnson District County Court is set for June 23.
