Democrats unhappy appointment being stalled by Senate committee

? Democrats are unhappy that Republicans are holding up Gov. Kathleen Sebelius’ selection for executive director of the Kansas Racing and Gaming Commission.

Topeka attorney Stephen Martino’s appointment by Sebelius, a Democrat, was supported unanimously by the Senate Federal and State Affairs Committee, which is composed of seven Republicans and two Democrats.

But when his name was submitted to the full Senate on March 31, it was withdrawn and referred back to the committee for further consideration. The Legislature adjourned the next day and will return for the wrap-up session April 27.

Senate Majority Leader Derek Schmidt, R-Independence, said Martino’s appointment was sent back to committee because several lawmakers questioned Martino’s qualifications, and whether he had any conflicts of interest.

Martino said he had no conflicts. He said he had a detailed knowledge of Kansas gaming laws, but that he had not represented any clients regulated by the state.

“I’m proud of my service to the state, and I look forward to serving in the future,” he said.

In 2002, Martino served as deputy campaign manager to Sebelius and helped raise campaign funds. Before that, he worked as a staff member in the House Democratic caucus.

If confirmed, Martino would replace Tracy Diel, who was appointed by former Gov. Bill Graves in 1996. Diel has declined to talk about the situation.

“My position serves at the pleasure of the governor and it’s her prerogative to make a change,” he said. “I appreciate the opportunity I have had to serve.”
