Driver in 2000 death imprisoned

A Missouri man convicted of running over a homeless Lawrence man in an alley more than three years ago now will serve prison time.

Douglas County District Judge Paula Martin ordered 24-year-old Joshua Mattocks to serve 32 months, after he violated the terms of his probation.

“The only thing I have to say, your honor, is you guys gave me a chance, and I threw it out the window,” Mattocks told the judge during the hearing Thursday morning. “I apologize to everyone in this case.”

Mattocks originally was sentenced to 30 days in jail and three years of probation for drinking and driving and killing 38-year-old John Lowe who was sleeping in an alley near West Ninth and Mississippi streets in April 2000.

Mattocks violated his probation in December 2002 when he was arrested on charges of driving under the influence after a traffic accident in Springfield, Mo. Court documents show his blood alcohol content was nearly twice the legal limit.

The judge said in light of the new charges she had no choice but to revoke Mattocks’ probation and send him to prison.

“To think you would drink and drive in this case after what happened in the underlying case is inconceivable to me,” Martin said.

Mattocks was taken into custody immediately following Thursday’s hearing.
