Suit rejected from convict in county double killing

A federal appeals court on Tuesday rejected a lawsuit filed by a man convicted of killing a couple in 1989 in Douglas County.

Tyrone Baker Sr., now 33, is serving four consecutive life sentences for the December 1989 crimes. Baker kidnapped and killed two elderly Topekans, Lester Haley, 87, and his wife, Nancy, 69. He is being held at Lansing Correctional Facility.

In 1998, Baker filed suit in federal court against the Kansas Department of Corrections and officials of Hutchinson Correctional Facility, where he was then held. He accused prison officials of indifference to a series of his medical problems, including hypoglycemia, hypertension, dental complaints and other ailments of his feet, back, legs, fingers and wrists.

The federal court dismissed most of the lawsuit, and a jury rejected the rest.

The Denver-based U.S. 10th Circuit Court of Appeals upheld the dismissals Tuesday.

“The record contains abundant evidence (Baker) has obtained treatment for his medical needs since 1992,” U.S. Circuit Judge Terrence L. O’Brien wrote for the three-judge panel. “At best, he disagrees with his health care providers and corrections officials as to the recommended treatment regime for his stated ailments. Such complaints are not of constitutional magnitude.”

The Haleys were kidnapped in Topeka and then shot to death in northwest Douglas County. Baker also kidnapped another Topeka woman, Verne Horne, 70, but she escaped.
