Judge: City must do it right in Wal-Mart case

The owners of land at 6th and Wakarusa, where Wal-Mart wants to build, must go back to the city and follow its process correctly.

That’s what Douglas County judge Mike Malone ruled Thursday afternoon.

He said the city failed to follow its own processes when it refused to issue building permits to 6Wak Land Investments, LLC, for the site in May.

Because the city did not formally deny the application, Malone said, they had made no official action for the owners of the site to sue over. He instructed the city to make a formal ruling on the application within seven days. If the city denies that application, the owners would next need to take their case to the city’s Board of Zoning Appeals.
