Controlling court

To the editor:

The Journal-World reports that Congressman Jim Ryun has presented a resolution in the House of Representatives called the “Constitutional Preservation Resolution.”

He has apparently badly confused the difference between the Supreme Court’s “referring to foreign and international law, and public opinion,” which the court has done, and the court’s “basing (its) decision(s) on foreign law,” which it has not done.

There is a long (and dishonorable) history of legislative attempts to manipulate the judiciary when the courts disagree with legislators’ views. This misuse and abuse of power attempts to undercut the uniquely American constitutional separation of powers. Your resolution might better be called “Constitutional Abrogation.” Hope you think about it.
