Woman pleads not guilty to 4th or subsequent DUI and two other felonies

A McLouth woman facing at least a fourth DUI conviction pleaded not guilty to three felonies Friday in Douglas County District Court.

Elisabeth Liana Mason, 47, waived her right to a preliminary hearing and entered the plea after her attorney, John De Marco, informed the court that his client was close to working out a plea deal with the Douglas County District Attorney’s Office.

The three felonies, including fourth or subsequent DUI, criminal damage to property and interference with law enforcement, are part of a six-count complaint that also alleges two misdemeanor counts of battery against a law enforcement officer and transporting an open container.

The charges stem from Mason’s arrest on May 21 in the 800 block of Vermont Street. The complaint alleges that her blood alcohol level was .21, which is nearly three times the legal limit of .08. The property she allegedly damaged is a 2023 Subaru belonging to another person.

The complaint lists her three previous DUIs as two in Douglas County and one in Wyandotte County.

Court records indicate that Mason had already pleaded guilty to a fourth or subsequent DUI in Douglas County in 2015.

Mason has also served time in the Kansas Department of Corrections for thefts, interference with law enforcement and battery.

Judge Stacey Donovan scheduled Mason’s plea hearing for Nov. 6.
