A Linwood man was sentenced on Thursday to more than two years in prison for attempted sexual battery involving a 75-year-old woman as part of a plea agreement with the state.

Warren Franklin Jones, 44, was originally charged in Douglas County District Court with one felony count of aggravated sexual battery, one misdemeanor count of mistreatment of a dependent adult and one misdemeanor count of theft, according to charging documents. The charges relate to an incident on Dec. 27, 2021, in Eudora.

Jones pleaded no contest to two felony counts of attempted aggravated sexual battery on May 8. Judge Amy Hanley sentenced him on Thursday to 31 months in prison, just over 2.5 years, for the first count and 13 months on the second count to run concurrently. Hanley said that Jones has accrued 284 days, 9.5 months, of time served since his arrest in September of 2022. Jones is required to register as a sex offender for 25 years after his release from prison.

Jones’ defense attorney, Angela Keck, said that Jones has several convictions in his criminal history that affected his sentence but that most of those were misdemeanors and his felony conviction for fleeing from police is from almost 10 years ago.

Court records indicate Jones was convicted in 2015 of felony flee and elude in Leavenworth County.

Deputy District Attorney Joshua Seiden said that Jones’ plea was mediated through the District Attorney Office’s Independent Assessment Conference program and it took extensive negotiations between himself and Keck. He said the victim was also a part of the process.
