Lawrence man, already accused of long-running sexual abuse of girl, facing additional child-sex charges in new case

A Lawrence man awaiting trial on multiple child-sex charges is now facing similar charges in a newly filed case.

Dustyn D. Polk, 46, is accused of two counts of aggravated indecent liberties with a child, one count of criminal sodomy and one count of indecent solicitation of a child, according to a charging document filed last week.

The two aggravated indecent liberties charges allege that Polk had sexual intercourse with a child in one incident and that he fondled the same child in a separate incident. The charges are level-three and level-four felonies, respectively.

The other two charges allege that Polk engaged in sodomy, a level-three felony, and solicited unlawful sexual acts, a level-six felony, with the same child. All of the charges allege the incidents occurred sometime between January 2009 and January 2010, when the child would have been 15.

Polk was arrested at the Douglas County Jail on suspicion of the new charges at midday Monday. George Diepenbrock, a spokesman for the sheriff’s office, said Polk was already in custody when he was booked on the new charges.

Polk was formally charged during a hearing Tuesday afternoon. Judge James T. George set a $50,000 cash or surety bond for the case.

Polk was already facing serious child-sex charges before his arrest on Monday. In a 2018 case, Polk faces two counts of rape, three counts of aggravated criminal sodomy and one count of aggravated indecent liberties with a child, according to an amended charging document provided to the Journal-World on Tuesday. Those incidents are alleged to have occurred between 2015 and 2018, beginning when the girl was 10, according to the complaint.

All six of the charges are off-grid felonies, meaning he could be sentenced to life in prison for each, if he is convicted. Polk is scheduled to stand trial on those charges in February.

In that earlier case, Polk told police that while he didn’t have a clear memory of the abuse, “he was sure” he had molested the girl, according to an affidavit police prepared in support of his arrest. Investigators further wrote in the affidavit, “Dustyn called himself a monster several times and said he was sorry.”

Polk is currently in custody on a $500,000 cash or surety bond for that case.

He is next scheduled to appear in court for both cases on Nov. 9.

The Douglas County Sheriff’s Office declined to release Polk’s booking photo to the Journal-World.
