Olathe man, 22, charged with rape in Lawrence

An Olathe man has been charged with rape and violating a protection order, according to court records.

Evan Phillip Hiesberger, 22, appeared in court on a summons and was formally charged Wednesday, Douglas County District Court records show.

The charging document in his case alleges that Hiesberger engaged in sexual intercourse with a 20-year-old who was overcome by force or fear on or about June 14, 2019. The document includes an alternative charge of aggravated sexual battery.

He is also accused of violating a protection from abuse order on Sept. 6, 2019. The charging document does not specify whether the second charge, a misdemeanor, is against the same alleged victim.

Both of the alleged incidents were reported to Lawrence police, department records show.

Hiesberger reported to the Douglas County Jail for processing Friday morning, jail records show. He was released about half an hour later on a $50,000 own-recognizance bond, according to the jail booking log.

His next court appearance is set for Feb. 18.
