Joe-College.com withdraws countersuit; trial date set

Larry Sinks and his Joe-College.com store has withdrawn its counter claims against Kansas University and, after a Friday arbitration hearing broke down without any agreement, will proceed to trial on Jan. 8, 2008.Kansas University is seeking to have Sinks cease and desist to use what the university says are federally protected trademarks on the shirts he sells from his store on Massachusetts Street. The lawsuit has been pending for nearly two years.Sinks said that the university is overstating what it controls and that he refuses to give in to their demands.Sinks’ store sells shirts that contain containing irreverent and sometimes oblique references to Kansas University and its athletic teams.Both sides said that it quickly became apparent during the arbitration meeting Friday that no agreement could be reached. Jim Marchiony, a spokesman for the Kansas athletic department, said that the university realized it would not be able to agree with what Sinks was asking for. The athletic department is charged with overseeing the use of KU’s trademarks.Sinks said the arbitration meeting was a sham, with KU saying it was its way or forget it.Both sides said there is no reason to expect the trial date to be moved from its current date.
