Victim in home-invasion robbery testifies that he was terrified by ‘guy in mask with a chair leg’

One of four victims in a Lawrence home-invasion robbery opened the trial Monday against 21-year-old Gabriel Alexander Patterson with his testimony about the early-morning hours of Nov. 8, 2014.

Patterson, of Lawrence, is charged with three counts of aggravated robbery and one count of aggravated battery and one count of aggravated burglary in connection with an alleged robbery at an apartment at 951 Arkansas St. on Nov. 8. At a preliminary hearing in December, co-defendant Zachary John Pence, 21, of Lawrence, testified that he, Patterson, Cody Kukuk, 22, and 20-year-old Lawrence residents Driskell Alan Johnson and Yusef Muhammad Kindell disguised themselves, broke into an apartment, battered its residents and stole marijuana, cash and an Xbox.

Shubhankar Mathur, a Kansas University senior, testified Monday at the trial that he woke up to a “commotion” in the hallway of his Hawks Pointe II apartment he shared with two friends. When he got up to open his bedroom door, Mathur said, he was terrified by what he saw.

“There was some guy in a mask with a chair leg,” Mathur said.

Mathur said the man with the chair leg, later determined to be Kukuk, then entered Mathur’s bedroom, followed by Pence and Johnson, who was holding a gun. The men ordered Mathur to give them marijuana and money or else they would “pull the trigger,” Mathur said. Mathur said the men left his room with “about a gram and a half of marijuana and $140 in cash.”

Mathur’s testimony will continue Tuesday. Patterson’s trial is expected to last through Wednesday. Kukuk, Johnson and Kindell have already taken plea deals. Pence is expected to plea Friday.

The Douglas County Sheriff’s Office refused to release Patterson’s booking photo. Douglas County District Judge Paula Martin denied the Journal-World’s request to photograph Patterson in court.
