Judge considers allowing man convicted of sex crimes to take back waiver of juvenile jurisdiction

Douglas County District Judge Kay Huff said she will consider allowing a 19-year-old Yuma, Ariz., man who pleaded guilty to multiple sex offenses in June to take back his waiver of juvenile jurisdiction in the case.

Antonio Yibran Martinez-Lopez pleaded no contest to attempted rape, aggravated sexual battery and aggravated indecent solicitation of a child. In April 2014, Huff ruled that Martinez-Lopez met the criteria to be tried as an adult after previously having been charged as a juvenile. He has been in jail since November 2013.

Each charge involved offenses alleged to have occurred before he turned 18 in August 2013. Martinez-Lopez was arrested on Nov. 4, 2013, in his hometown of Yuma, Ariz., and brought to Douglas County to be charged later that month.

At a hearing Friday, Martinez-Lopez’s attorney argued that his client was misguided when he waived juvenile jurisdiction under a previous attorney. The prosecution disagreed.

Huff took the matter under advisement and will issue a ruling at a later date. Martinez-Lopez is set to appear next on May 1, at which point Huff may proceed with sentencing, assistant to the district attorney Cheryl Wright-Kunard said.
