No charges for Lawrence police officer arrested on suspicion of battery

No charges will be filed against a Lawrence police officer who was suspended with pay after his arrest on suspicion of battery Sunday, Lawrence Police Department spokesman Capt. Paul Fellers said Friday evening.

Lawrence police arrested Nicholas Charles Simon, 23, at a Remington Square apartment, 4100 W. 24th St., at 2 p.m. Sunday, according to the Douglas County Jail booking log.

Simon is assigned to the patrol division with the LPD, Fellers said. Fellers would not release a description of what led to the arrest, as is general practice with incidents handled by the department, because it is a “personnel matter,” he said.

Simon was released from jail Monday afternoon. Douglas County District Attorney Charles Branson did not file charges after reviewing the “reports, evidence and consultation with the victim,” assistant to the District Attorney Cheryl Wright Kunard said Friday.

“The evidence revealed that there (were) conflicting statements about the event, and there were mitigating circumstances present,” Kunard said. “The victim expressly requested that no charges be filed.”
