District Attorney amends charge to attempted murder in apartment wall shooting

The Douglas County District Attorney’s Office amended the charges against a Lawrence man who was arrested in January after a firearm was discharged and a bullet struck a man in a neighboring apartment.

Phillip Howard, 29, of Lawrence, was charged with aggravated battery and aggravated assault after the incident in January. During his arraignment on Monday, the District Attorney’s Office filed amended charges of attempted murder, aggravated battery, and criminal damage to property.

On Jan. 18, Lawrence police responded to reports of a dispute at Peppertree Apartments, 3300 W. 22nd St. According to police, the argument occurred in an apartment and in a hallway outside of the apartment.

Martin Gibson, 33, was in a neighboring apartment while the dispute was going on. A gun fired, and the bullet traveled through Gibson’s apartment door, striking him in the thigh.

After a brief police standoff, Gibson was taken to Lawrence Memorial Hospital with serious injuries. Almost two weeks after the incident, the bullet was removed from Gibson’s leg.

According to documents from the District Attorney’s Office, Howard allegedly fired a handgun at another person with the intent to commit murder.

The District Attorney filed a charge of aggravated battery against Howard, alleging that he caused great bodily harm to Gibson. The last charge is for allegedly causing damage to the apartment door, as well as a window, fence, gutter and drain pipe at Peppertree Apartments.

Cheryl Wright Kunard, assistant to the District Attorney, said Howard’s preliminary hearing is set for June 16.
