Aggravated battery charge dismissed in apartment pool shooting case

Prosecutors have dismissed one count of aggravated battery in the case of a Lawrence teen involved with a May 31 apartment pool shooting.

Alex Caprice Sanders, 18, was arrested June 5 on suspicion of criminal possession of a firearm and aggravated battery. Prosecutors dismissed the latter charge at Sanders’ Thursday preliminary hearing, said Cheryl Kunard, assistant to the Douglas County district attorney.

Sanders’ charge is connected to two gun-related incidents on May 31, Lawrence Police Department spokesman Trent McKinley said in June. The first occurred around 12:30 a.m. outside Shots bar, 1008 Massachusetts St., when two individuals police believed to be rival gang members were involved in an altercation that led to one person being threatened with a handgun, McKinley said. The two people separated without firing the gun.

McKinley said after the bar closed, an after-hours party took place at the Grove Apartments, 4301 W. 24th Place. Police responded to a reported shooting there at 2:38 a.m., McKinley said. Witnesses reported that multiple gunshots had been fired near the pool and that at least one person had been struck. An 18-year-old Topeka man was taken to Lawrence Memorial Hospital, where he was treated and released.

Kunard said the only witness at the Thursday hearing claimed to have no memory of the events of the case or discussing the case with the police.

Though the aggravated battery charge was dismissed, Sanders was bound over on the charge of criminal possession of a firearm by a convicted felon. Sanders’ bond was subsequently reduced from the original $80,000 to $20,000.

Sanders’ jury trial is set for Sept. 17.
