Douglas County prosecutors have filed drug charges against a 32-year-old Lawrence man who has spent time in prison related to a 2005 Lawrence sexual assault case.

According to the charges, prosecutors accuse James F. Auten of possession with intent to distribute marijuana, possession of drug paraphernalia and distributing or possessing marijuana as a dealer without a drug tax stamp. Auten is listed as a current Kansas University student, and he said in court Tuesday he was trying to work as a tutor at the university as well. Prosecutors allege the drug crimes occurred June 29.

Auten has been on parole since October 2010 after he was sentenced in 2006 to serve 65 months in prison after he entered a plea to aggravated sexual battery, aggravated battery and aggravated assault after a female acquaintance alleged he raped her, stole her phone and held her in a bedroom at knife-point in May 2006 at his home at the time in northwestern Lawrence. He also had a case dismissed around that same time after he was accused of calling in a bomb threat at The Granada, 1020 Mass.

Pro-tem judge James George on Tuesday set Auten’s bond at $20,000 cash or surety based on his past criminal history.
