40 years ago: Evidence seized in Barton County gambing raid ruled illegal

From the Lawrence Daily Journal-World for Jan. 6, 1972:

A district court recently had ruled that gambling raids conducted in October in Great Bend, Kan., by Atty. Gen. Vern Miller were illegal because law enforcement officers had not secured search warrants. District Court Judge Frederick Woleslagel ordered that any evidence seized during the raids and any evidence based on observation or interrogation during the raid be suppressed. Miller had contended that no search warrant was needed under a law requiring private clubs to be open to inspection, but the judge said that the raids were not “inspections” as defined under the liquor control laws. Miller vowed to appeal the ruling and pledged to continue his crackdown on all forms of gambling in Kansas.
