Lawrence robbery suspect pleads on day of trial

A 24-year-old Franklin County man entered a plea Monday in connection with a robbery last March in the 800 block of Hilltop Drive.

Dustin A. Smith, of Richmond, had a jury trial scheduled for Monday but instead entered a plea to one count of conspiracy to commit aggravated battery, his defense attorney Branden Smith said.

Prosecutors accused Dustin Smith of participating in the robbery with co-defendants Mikael Englund, 23, also of Richmond, and a juvenile. Englund is accused of participating in another robbery at the same residence a few weeks earlier, and he faces an April 2 trial.

The victim in the case testified at a hearing last December that in mid-March 2011 three men, Englund and two men he couldn’t identify, injured him and robbed him at his residence. The victim did not report the crimes to police until after the second robbery.

At his March 28 sentencing, Dustin Smith faces anywhere from 17 months to 46 months in prison, but if he has no past felony convictions, he is eligible for probation under the state sentencing guidelines.
