A judge Friday sentenced a 26-year-old Lawrence man to serve 57 days in jail and three years on probation for having a sexual relationship with a 14-year-old girl over a seven-week period.

District Judge Kay Huff ordered Devin Rapp to follow strict probation guidelines, including participating in sex offender, mental health and alcohol and drug treatment programs.

Amy McGowan, a chief assistant district attorney, the victim and the victim’s family had asked Huff to sentence Rapp to serve 32 months in prison, but the judge followed an argument from Rapp’s defense attorney David J. Brown, who asked for the strict probation term.

“I do find that there are appropriate treatment programs which are more likely than prison to reduce the risk of offender recidivism,” Huff said.

Rapp pleaded no contest in July to one count of attempted aggravated indecent liberties with a child after prosecutors accused him of having a sexual relationship with the girl at a west Lawrence apartment from December 2010 to Jan. 31. A specialist who evaluated Rapp said he would be a low risk to re-offend and that he would benefit from treatment out of prison, Huff said.

Huff said in her ruling that Rapp had harmed the girl and her family by his actions, and she ordered him to register as a sex offender for his lifetime.

The judge did rule that Rapp could be released to work at his fast-food job during his 57-day jail term. If he’s found to violate his probation, Huff could order Rapp to serve 32 months in prison.
