Atchison man accused of attacking Lawrence man taking late-night walk

Douglas County prosecutors have filed an aggravated battery charge against a 22-year-old Atchison man who is accused of punching and injuring a Lawrence man early Thursday.

Prosecutors Thursday filed the aggravated battery charge against Joshua W. Downing, and a judge set his bond at $20,000, cash or surety. Sgt. Matt Sarna, a Lawrence police spokesman, said Downing was accused of punching a 21-year-old Lawrence man in the head as the victim was walking near Lawrence High School along 19th Street.

Sarna said the victim was walking with some friends around 2:40 a.m., and they alleged the suspect, Downing, and another man pulled up alongside the group in a silver car. The suspect then got out of the car and struck the victim, who fell to the ground.

The victim was taken to Lawrence Memorial Hospital for treatment. Officers located the car in the 2100 block of Vermont Street and arrested Downing. Sarna said Downing and the victim did not know each other.

Downing has a court appearance set for Tuesday. An LMH spokeswoman said the victim was treated and released.

So the dude who got beat up was with friends who did nothing to help their friend out? A friend of mine was jumped (I was not with him) but the friend who was took off running. His excuse was that he was trying to get away to call 911...epic friendship fail

Another time the dude got in a fight with 3 guys and his friends did help out but unfortunately one of his friends suffered a heart attack due to the stress. That is what you get when you mess with nihilists. Say what you will about the tenets of national socialism but at least its an ethos.

The laws regarding self-defense are that you can't "escalate" in self-defense.

So, if somebody hits you, you can hit them back, but you can't shoot them.

It's a bit odd, given the emotional nature of fights, that the law mandates such strict guidelines, but that's the way it is.

I call BS on this statement. So according to jafs, if someone hits you with a club, you can only club him back. Or if a man attacks you with a knife, you have to use your knife. No guns allowed unless someone attacks with a gun. Pure BS. All of these mentions attacks could put you in fear of your life, thus self defense can be whatever you have available.

yeah, or most likely he would have gone for the gun and then the guy in the car would have blown them both away with a shotgun. Or, he would have pulled a gun shaking with adrenalin and his mind racing and fired wildly at the last second at the attacker and killed his friend instead, or someone sleeping in their bed across the street.

I've heard that bear mace is good to have. It was explained that hikers and hunters will use it if they encounter bears. Same principle with walkers and thugs.

I bet there is more to the story than is here. The "victim" could have done something to egg it on. And where were his friends... Why wasn't Downing laid out? Although things could have happened as this vague report presents it, and what Downing did sure as hell not right, I bet there is more to the story and I bet the "victim" isn't totally blameless.
