Former Baldwin bar manager enters no-contest plea to serving alcohol after hours

A former manager at a Baldwin City bar pleaded no-contest Wednesday to one misdemeanor count of serving alcohol after hours.

Prosecutors agreed to drop a second charge against Douglas S. Delaney, 51. James McCabria, an assistant Douglas County district attorney, said a police officer observed two bottles of beer on the counter at 3:30 a.m. June 13 at The Salt Mine, 301 Ames St. The officer said he saw a woman inside drink from one of the bottles and Delaney holding onto a bottle, although he didn’t see Delaney drink from it, McCabria said.

It is illegal for a drinking establishment to permit the serving or consumption of alcohol on its premises between 2 a.m. and 9 a.m., according to prosecutors.

During a hearing on Monday, Delaney contended he and an employee were cleaning up after a busy night. He faced the same charge for an Aug. 21 incident, but prosecutors agreed to drop it.

The Baldwin City Police Department in December identified Delaney as an owner of the bar, but McCabria said Delaney told the officer he was a manager. The state’s Alcoholic Beverage Control online directory Wednesday listed the owner as Michael A. Magers. According to the ABC, the establishment was assessed $600 for the two incidents.

“As a result of this, I have resigned my position there, so it’s not to have an effect on the business at all,” Delaney told District Judge Sally Pokorny. “I’m sorry. I don’t know what else to say.”

Pokorny ordered Delaney to pay a $100 fine plus $155 in court costs.

Of all the lame-brained articles I've read here on LJW, this is about the MOST stupid!!! And some of the posts are just as ridiculous...

windjammer has GOT to have a relative or friend hanging out around the DA's office, yes, windjammer?? I'm sure you're MUCH appreciated by the DA's office, windjammer. They should make you their official spokesperson!

Delaney, I wish you had not resigned. I don't know you, but this is a bunch of garbage...I would not have let this ridiculous DA's office and that "Barney Fife" of a police officer make me resign!!! A LOT of us are on your side!! I'm sorry about this, Delaney...ralphralph is SO right in his post. But I'm supposing you did what you felt was right for you...perhaps not even wanting to deal with people such as Branson and McCabria. Can't blame you for that!! (I don't mean to be putting words in your mouth, Delaney...I'm trying to figure out this whole mess.) It's quite unbelievable to me.

Bars have hours when the can't serve a drink, now that is straight out of the 1930s. It's illegal to whistle underwater in Vermont too. HA!

I remember the days working in a bar. Sometimes after a particularly busy night we would sit down and have a drink. I'm pretty sure a lot of people, no matter what the occupation, drink after work.. Yes I know it is against the law in a drinking establishment! The most famous sheriff of all use to tell Barney, "Sometimes you have to use the human equation!"

Why are we spending taxpayer's money regulating this? If someone wants a beer at 3:30 AM, what business is that of mine or yours? Maybe they work from 5PM to 3AM? Maybe they just like to drink late? I don't care, and I don't want my tax dollars spent chasing this crap around.

C'mon, Kansas! Leave the past behind! Prohibition ended before my mom was born, and we're still chasing the 'shiners through the dark in Baldwin City. How about we just leave it up to people to make their own decisions, and impose consequences on them for actual bad conduct, and not just the possibility that they might behave badly if they aren't living like "we" think they should.

Kansans need to grow up and quit being such a bunch of little yuppies. There is so much more to life then following some religious motivated law designed to dictate your life. Who cares if its the law, it also use to be against the law for women and blacks to vote. Grow a #%$# back bone people!!!

I can't believe this one. I used to work at a bar (20 yrs ago) , and it was common on a busy night to be cleaning up at 3 am. I am very surprised to read about this establishment.

I eat lunch at this bar on Fridays, and its the best fresh shrimp either grilled or fried.... If it's still open, you should try it. It's worth the wait.

Of course Baldwin does have a Sonic......................
