A federal grand jury in Kansas City, Kan., has indicted a 32-year-old Douglas County man accusing him of failing to register as a sex offender.

The indictment is the latest legal action taken against Gustav Brune, who had been living in rural Eudora, after federal prosecutors earlier this month took Brune into custody on charges he failed to register on Nov. 30 and failed to keep his registration up to date. Brune has a 2001 federal conviction for possession of child pornography.

The federal case against Brune came after Douglas County prosecutors dropped three felony charges during a jury trial accusing him of failing to comply with the Kansas Offender Registration Act. Brune and his defense attorney argued he was not required to register because under the language in the state statute his federal conviction would not be considered a sexually violent crime.

But soon after the Douglas County case was dropped, federal prosecutors decided to seek their own registration charges, and the U.S. Marshals Service arrested Brune. According to U.S. Attorney Barry Grissom’s office, Brune now faces a maximum sentence of 10 years in prison if convicted.
