Judge dismisses jurors in Douglas County sex crime trial after prosecutors move to dismiss charges

A judge dismissed a pool of Douglas County jurors who were called for a Douglas County sex crime trial originally scheduled for Tuesday after prosecutors moved to dismiss the charges against a 32-year-old man in the case.

District Attorney Charles Branson said he could not comment on the case other than to say it had been dismissed without prejudice, meaning prosecutors could refile charges against the man if they do it within the five-year statute of limitations.

Prosecutors earlier this year accused the man of sexually abusing one girl and attempting to abuse her younger sister when the girls lived in Lawrence from 2007 to 2009. According to testimony at an earlier hearing, the defendant, who had a Garden City address at the time of his March arrest, is the ex-boyfriend of the girl’s mother and had lived with the family in Lawrence. The girls are now 13 and 11 years old, and they alleged the abuse occurred while their mother was at work.

The Journal-World generally does not identify sex crime suspects unless they are convicted.
