Hearing set for Thursday in attack of bicyclist along South Lawrence Trafficway path

The district court is looking to expedite hearings concerning the man who attacked and attempted to rape a woman on a Lawrence bike path. The victim in the case is a foreign student and is scheduled to leave Lawrence next week.

Evidence will be heard Thursday in the case of a man accused of grabbing a woman off her bike, attempting to rape her and then stabbing her.

During a court appearance Tuesday morning for William Nichols, 30, Lawrence, Douglas County District Attorney Charles Branson asked the judge to set a preliminary hearing in the case as soon as possible because the victim is a foreign student who is scheduled to leave Lawrence next week.

Judge Peggy Kittel scheduled the preliminary hearing on Thursday for Nichols, who is charged with aggravated kidnapping, attempted rape and aggravated battery. He’s accused of grabbing the 23-year-old victim off her bike on the South Lawrence Trafficway bike path about 3:15 p.m. last Wednesday, dragging her into tall grass and brutally attacking her.

Nichols appeared in court Tuesday wearing a yellow jail jumpsuit and with his court appointed attorney, Michael Clarke. Nichols’ bond is set at $500,000, and he remains in custody at the Douglas County Jail.

Can you find me an instance of that, please? There's at least 6 years of searchable archives up here with comment threads. Dozens of liberal folks on the boards over the years. Find a thread with more than one person 'pleading for understanding' on something more serious than a victimless drug charge. Should be easy, right?

I'm not a liberal, and I do think that people are a product of their environments AND that they don't get a free pass because of it.

Believe me, the difference between this guy and the rest of us who don't commit these crimes is about their experiences early in life AND about the way they chose to respond to those experiences. It's a cocktail of both/and: they probably wouldn't be perps if someone hadn't perped them at some point AND they still had a clear choice to make about whether or not to commit sex crimes.

I did read your whole post. Found it pretty convoluted. Yes, if you have empathy and the capacity to understand human behavior you can see more than just good and evil. But you're saying the liberal types do that most of the time and then turn around and "demand castration" when the crime is violent and sexual? And that there's a "lack of humanism on the part of many bleeding hearts" in this type of situation? Sorry. It's clear that this fellow who you call an "alleged offender" (he was caught in the act and there were witnesses) is not well, and whether or not his past or upbringing has contributed to his recent actions, he is currently a threat and needs help and to be housed away from the rest of us. Just what this one liberal thinks, anyway.

It's not a "liberal" attitude to respect the right of a woman not to be assaulted. It's called a "human" should try it sometime.

Actually, If she was unable to come back for the trial,so long as she testifies at the preliminary hearing and the defendant gets to cross examine her, her testimony can be used at trial upon a finding that she is unavailable.

At the very least, per K.S.A. 60-459, if a witness is unavailable because she is outside the jurisdiction of the court, the court would have to try to get the witness to participate in a deposition. It isn't a slam-dunk that her prelim testimony could be used at a subsequent trial if she doesn't testify in person at trial.

Depositions have to be ordered by the court in criminal cases. This is very rarely done, but does require the party seeking the deposition to make a showing that the witness will be unavailable. The court, if a preliminary hearing were an option, would rule a deposition unnecessary.

It is definite that her prior sworn and cross-examined testimony could be used at trial. The state would first have to show that they made reasonable attempts to find her and procure her presence at trial.

Ah yes, the voice in the woods, a beacon of light in the fog of present culture, so persecuted. It is really interesting how you can't even wait to see a comment that you find so disgusting. You just think of something that someone could possibly say and then wax predictably about your off-the-shelf fear of the "liberal agenda". Get outside your own head much?

Whether you are just self-conscious, a paranoid or a narcissist, here is some illiberal advice: get over yourself. Fighting self-generated straw men doesn't make you look brave or intelligent. It makes you look very silly.

consumer1... I haven't seen anyone standing up for this attacker. Liberal, conservative, tea partier or bullmoose. You probably would like to see your opposition party do that but I haven't seen it from anyone. You seem to be the only one on the attack and making this political.

One who posts a deliberately provocative message to a newsgroup or message board with the intention of causing maximum disruption and argument

One who purposely and deliberately (that purpose usually being self-amusement) starts an argument in a manner which attacks others on a forum without in any way listening to the arguments proposed by his or her peers. He will spark of such an argument via the use of ad hominem attacks (i.e. 'you're nothing but a fanboy' is a popular phrase) with no substance or relevence to back them up as well as straw man arguments, which he uses to simply avoid addressing the essence of the issue.

An older gay male, usually over 35 or so, who hits on younger guys who aren't interested in him. When they tell him they aren't interested, the troll will often flip out and get angry. Trolls are not just something seen in chat rooms but can be found just about anywhere people hang out/gather. Many trolls are secretly into underage guys but don't talk about it unless they are talking to another troll who is into the same thing, or if they are talking one-on-one with an underage guy.

Just as bad as trolling is "Feeding the Trolls". This is when people say stuff that they know will prompt someone to respond with a trolled reply and/or replying to comments that are blatantly from a troll. This is especially true when a troll first makes his comment/reply, and (usually many) people respond, either trying to correct the troll, or express anger at the statement. At that point, the trolling was successful and has been fed. When encouraged by success and feeding, trolls often return.
