Kansas Court of Appeals upholds ruling that prohibited Club Axis from operating

The city was within its legal rights when it ordered a controversial nightclub to close after it contended the business did not offer enough parking places.

The Kansas Court of Appeals has upheld a Douglas County District Court ruling that prohibited Club Axis from operating at 821 Iowa unless it took actions to come into compliance with the city’s parking code.

After connecting multiple incidents of violence to the establishment, the city raised the issue in court in early 2008 that the nightclub was operating without an approved number of parking spaces.

The business remained open, however, for more than a year without making any changes. The city in July 2009 filed a lawsuit seeking an injunction to force the business to cease operations or come into compliance.

The club has been closed for months, and its owners previously have said they are not interested in reopening the business.
