Nevada trucker to go to court in 2011 after more than $525,000 confiscated in Shawnee County traffic stop

A Las Vegas truck driver will make his case next year that his federal rights were violated when more than $525,000 was confiscated from him during a northeast Kansas traffic stop.

Eduardo Arencibia was accused of transporting drug money. But the charges were dropped because the money couldn’t be presented at trial. It had already been exchanged at a Topeka bank for a cashier’s check.

Arencibia has filed a federal lawsuit seeking $1 million from Shawnee County Sheriff Richard Barta and five of his deputies.

The Topeka Capital-Journal reported that a Dec. 5, 2011, trial date was set in the case Monday in federal court in Kansas City, Kan.
