A Baldwin City man accused of shooting his neighbor in the head was bound over for trial during his preliminary hearing Monday morning in Douglas County District Court.

Brian L. Pitts, 35, faces a felony aggravated battery charge, as well as added charges of aggravated burglary and criminal damage to property, a spokeswoman for District Attorney Charles Branson said. A jury trial was scheduled for 9 a.m. Feb. 9.

Daniel T. Sumner, 32, was taken to Kansas University Hospital by helicopter ambulance with a bullet wound to the head after an Aug. 2 shooting. He was released Aug. 4. The shooting happened in the basement of Sumner’s home, in the 200 block of Elm Street. Police said numerous shots were fired, but only one grazed Sumner and tore back his scalp.

Pitts was arrested by Baldwin City police soon after the shooting. He was released from jail Aug. 6 on $75,000 bond and ordered not to have contact with the victim.

The case is being heard by District Court Judge Paula Martin.
