Witness implicates cousin in killing

A co-defendant testified again Wednesday that his cousin fired the shot that killed a Lecompton man during a 2005 botched burglary in Douglas County.

Leonard Wayne Price, 47, who has already pleaded guilty to felony murder in the case, took the stand against his cousin, Allen Dale Smith, 37. Smith faces felony murder and aggravated burglary charges for the death of Clarence David Boose, 77, a retired jeweler who interrupted a burglary at his home.

Price said Smith used a pistol to shoot Boose from behind.

Smith’s attorney has argued that his client’s alibi puts him in Topeka baby-sitting and not with Price during the burglary. Prosecutors allege the pair conducted several burglaries in the area around that time.

The trial will continue today. Smith’s first trial in the Boose case in August ended with a mistrial.
