Driver in idling car arrested for DUI

The sound of a revving engine attracted the attention of a Lawrence police officer patrolling the 700 block of New Hampshire Street on Wednesday night.

The officer found a Lawrence man slumped in a parked and locked sport utility vehicle with the engine running, according to a police report. Initial attempts to rouse the man failed.

Other officers arrived to assist and at one point the motorist woke up long enough to attempt to put the vehicle into gear. He then slumped over again.

Police managed to get the driver's side door unlocked and opened just as the man woke up again and unlocked the passenger side door.

Police took the man to jail for driving under the influence.

I bet next time he remembers to take the keys out the ignition before he passes out. I think as long as the keys are in the ignition they can get you for DUI.

He should have shut the engine off and taken the keys out of the ignition. That way there would have been No Intent! Hell, I'm just getting ready to head over to the liquor store myself!

He was probably arrested for Operating under the influence, not Driving under the influence.

Even if the car was not running and the keys were in his pockets he will still face the same charge. I think that is BS but it is the law in some states.

Seems like the engine would have to be running to me, what if he just got in, turned on the radio and planned on sleeping it off for awhile?
