Convictions rare in cases of weapons downtown
Legal outcomes may surprise some
They were arrested or cited by police for bringing a gun or other weapon to Lawrence’s downtown bar district.
But then what?
One man got a diversion agreement and had charges dropped. Another faces the possibility of a federal gun charge. Some skipped court dates and now have warrants for their arrest.
Some haven’t been charged with anything.
Those are some of the outcomes of the criminal cases generated since the beginning of 2006, when Lawrence police began regularly spotting guns inside vehicles while on downtown patrol – especially in parking lots near Last Call, 729 N.H.
Since Jan. 1, 2006, 16 people have been charged in municipal court with carrying a concealed weapon near a bar, according to court records. All but three of those happened in the 700 block of New Hampshire Street. The remaining three were in a parking lot in the 800 block of New Hampshire Street; at the Kwik Shop, 845 Miss.; and at Club 508, 508 Locust.
Here’s a look back at some of the incidents and an update on where they stand:
¢ Jan. 7, 2006: Matthew S. Clark-Gibson is charged with carrying a concealed weapon and public consumption of alcohol around 11 p.m. in the parking lot of Borders, 700 N.H. Outcome: Clark-Gibson, a Kansas City-area resident, pleaded guilty to public consumption of alcohol, but city prosecutors dismissed the gun charge. He received a suspended jail sentence and paid $92 in fines and fees.
¢ Jan. 8, 2006: Around 3 a.m., police cite Jerry E. Hicks, 19, Kansas City, Mo., in the 700 block of New Hampshire for being a minor in possession of alcohol and carrying a concealed handgun near a bar. Outcome: He reached a diversion agreement, which means charges will be dropped if he stays out of trouble. His diversion is up for review March 22 in municipal court.
¢ Jan. 15, 2006: Police spot a handgun in a vehicle in the parking lot of Borders, 700 N.H. and arrest Anthony Lamar West, 25, Kansas
City, Mo., for drug charges and being a felon in possession of a firearm. Ouctome: West was sentenced to 18 months’ probation in November after entering a plea in District Court to possession with intent to sell marijuana and possession of cocaine.
¢ Jan. 29, 2006: Police see two handguns sticking out from under front seats of a vehicle in the Borders parking lot. They eventually
see four men approaching the car and arrest the driver, 22-year-old
Charles A. Barker of Kansas City, Kan., for being a felon in possession of a firearm. Outcome: Barker was charged in District Court with possession of marijuana and defacing the identification marks on a handgun. His attorney argued police didn’t have grounds to search the vehicle, and in May Assistant District Attorney Trent Krug dismissed the case “to be referred for Federal prosecution.” So far, Barker has not been charged in federal court.
¢ Feb. 17, 2006: Police seize an MAK-90 rifle belonging to a
27-year-old Eudora man after a passerby spots it in an open trunk on a Friday night in the city’s parking lot at 825 N.H. The man, Williams J. Backman, is charged with carrying a concealed weapon near a bar, but prosecutors eventually dismiss the charge. According to a police report, he said at the time that he had been trying to pawn the gun and forgot he had it in his trunk.
¢ May 21, 2006: Police seize a sawed-off shotgun, 9mm rifle, and suspected marijuana and crack cocaine from two vehicles parked side by side in the parking lot of Borders, 700 N.H. Outcome: As of Friday, none of the four Kansas City, Mo. residents arrested in the case, ages 18 through 21, had been ormally charged.
¢ May 28, 2006: Romond V. Simpson is cited for carrying a concealed weapon near a bar at 700 N.H. Outcome: He failed to apepar in municipal court June 14 and has a warrant for his arrest, according to court records.
¢ June 25, 2006: Police recover an AK-47 rifle and two pistols from a pickup truck in the 700 block of New Hampshire. They cite three Kansas City-area men, Devin L. Parker, Stefaun M. Robinson, and Shawn M. Robinson, all ages 20 through 22, for carrying concealed weapons near a bar. Outcome: All three pleaded guilty, received a 180-day suspended sentence, and paid $142 each in fines and fees.
¢ Aug. 6, 2006: Police arrest Jonathan William Payne, 24, Kansas City, Kan., for criminal trespassing and carrying a knife near a bar after he refuses to leave Last Call. Outcome: He failed to appear in court Sept. 21 and has a warrant for his arrest, according to municipal court records.
¢ Sept. 3, 2006: Police spot an AK-47 assault rifle in the Borders parking lot. They arrest Desmond R. Clark, 19, Grandview, Mo., for
carrying a concealed weapon near a bar. Outcome: Clark pleaded guilty to consuming alcohol in public, but the gun charge was dropped as part of a plea agreement. He paid $252 in fines and fees and got his jail sentence suspended.
¢ Nov. 19, 2006: Police arrested Damario D. Brooks, 22, Topeka, in the 700 block of New Hampshire for carrying a weapon near a bar, reckless driving, possession of drug paraphernalia and other charges. Outcome: Brooks failed to appear in court Dec. 11 and has a warrant for his arrest, according to court records.
¢ Dec. 10, 2006: Derrick T. Jenkins is cited for having a concealed weapon at 700 N.H. Outcome: His next court date is March 9.
¢ Dec. 15, 2006: Police arrest two Kansas City, Mo., men, Richard Vonelle Cooper, 23, and Damen T. Carter, 21, for gun violations after
finding a Bushmaster Carbon 15 pistol with a 30-round magazine and a Ruger Mini-14 with a 100-round magazine in a vehicle in the Borders parking. Outcome: Cooper is due in municipal court Feb. 22. Carter made a first appearance in District Court, but the status of his case was unclear Friday.
¢ Dec. 24, 2006: Police arrest Thomas J. Kelly II, 18, Kansas City, Mo., for criminal trespassing at the club and carrying a concealed weapon. Outcome: He is due in court Jan. 24.
¢ Dec. 31, 2006: Brandon T. Hooker, 19, Kansas City, Mo., is arrested for carrying a concealed weapon at 700 N.H. Outcome: He was released on bond and is due in court Jan. 24.
