Marine guilty in plan to murder Iraqi man

— A Marine was found guilty Wednesday of conspiracy to murder an Iraqi man, but was acquitted of premeditated murder and kidnapping in a bungled attempt to kill a suspected insurgent last year.

Cpl. Marshall Magincalda also was found guilty of larceny and housebreaking, and cleared of making a false official statement.

Prosecutors said that during a nighttime patrol in April 2006 in Hamdania, Iraq, the Marines' squad hatched a plan to kidnap and kill a suspected insurgent from his house. When they couldn't find him, they instead kidnapped a neighbor, dragged him to a hole and shot him.

He planned to kill one man. When the man he planned to kill was not there he had to kill something. So he just killed somebody else. ...kinda like the old song... If you can't kill the one you hate, Just hate the one you you kill.
