Jury still out in case of N. Lawrence shooting

A jury this morning will enter its second day of deliberations in the trial of a Lawrence man charged with shooting a woman in the face.

Domonic A. Shepherd, 25, is charged with attempted second-degree murder for the Sept. 18 shooting at an apartment in the 700 block of Comet Lane. After a two-day trial, jurors began deliberations about 10:30 a.m. Wednesday but had not reached a verdict by day’s end.

Dist. Atty. Charles Branson said Shepherd intentionally shot the victim, 23-year-old Kelley Johnson, and tried to shoot another woman, Danielle Williams, after he refused to leave Williams’ apartment and the two women threatened to call police. Shepherd had come to the apartment with a friend, but was stranded when the friend left.

Branson asked why Shepherd waited until his trial to give his version of events, which was that Johnson got in his face, he shoved her, Williams pulled a gun, and the gun went off accidentally during a struggle.

“He’s finally telling his story now. Why?” Branson asked. “It’s his story versus everybody else’s story, and who do you believe?”

But defense attorney Tom Bartee said Shepherd’s version made more sense. Johnson said she never saw a gun, and Bartee asked why Johnson’s hands weren’t up and why her head wasn’t turned if, as alleged, Shepherd had stuck the gun in her face before firing.

“Did he stick a gun in Kelley Johnson’s face and shoot it trying to kill her, or did something else happen?” Bartee asked. “It was a struggle, and it was a shock to everybody involved when that gun went off.”
