KBI investigating shooting by officer

? A Winfield police officer shot and killed a man believed to be involved in a robbery, prompting an investigation by the Kansas Bureau of Investigation, authorities said.

Danny Fruits, of Winfield, was shot Wednesday during the investigation of a crime that had just occurred, Cowley County Attorney Chris Smith said.

The shooting occurred at Tunnel Mill Dam, but Smith declined to say what provoked the officer to fire.

“The Kansas Bureau of Investigation is involved, and they will issue a report to me when they have concluded,” Smith said. “At that point we’ll decide whether charges will be filed or justified.”

The KBI investigates all shootings involving police. The officer who shot Fruits has been placed on leave during the investigation, which Smith said will include a review of video from the officer’s patrol car.

Smith did not know whether the camera captured the shooting.
